Claiming Tax Deductions for START-UP COSTS

for a New Business

 

“Costs incurred during the START-UP PHASE of a business are generally deductible over a 15 year period”

(i.e., each $1,500 in start-up costs would be deducted at a rate of $100 per year for 15 years). [ IRC Sec 195(c)(1)(A) ]

 

 

WHAT IS THE “SPECIAL DEDUCTION”

FOR 2011?

 

Any taxpayer who begins operation of a new business in 2011, may deduct ALL start-up costs (up to $5,000 maximum) on their 2011 tax returns — no need to spread the deduction over a 15 year period. [ IRC Sec 195(b) ]

 

 HERE IS AN EXAMPLE: $5,000 in Start-Up Cost deductions, for a person in a 28% tax bracket, would generate a $1,400 tax Refund.

 If Start-Up Cost deductions exceed the amount of money earned this year in the home-based business itself, most or all of the additional deductions may be applied against any other source of income such as a W-2 job, which could possibly even drop the taxpayer into a lower tax bracket.

 

This one-time write-off provision in the tax law is valid only during 2011, and therefore will set to expire permanently at midnight, December 31, 2011.

 

Even IF Congress reinstates this provision in 2012, a business begun after Jan. 1, 2012 will not be able to claim those deductions until April 2013 – when 2012 Tax Returns are filed.

 

Not activating a new home-based business by December 31, 2011, will delay tax-deductions for Start-Up Costs by at least 15 months.

WHAT ARE “START-UP COSTS?”

The term includes business related costs you incur prior to actually beginning to offer goods or services for sale _ i.e., the costs of getting ready to open your business. They are generally the same types of expenses that will be called “business operating costs” once you are actually operating a business.

Caveat: Money spent qualifying to begin a certain type of business, general are not deductible. This includes getting a degree, obtaining a license to practice (doctors, real estate…), etc. The IRS “default setting” for start-up expenses is to deem that the taxpayer made a decision to amortize the amounts over a 15 year period. [ Reg Sec 1.195-1T(b) ]

To keep that from happening, and claim your deductions immediately, you should take 2 actions: [ Reg Sec 1.195-1T(b) ]

 

1. Claim your Start-Up Expenses on IRS Form 4562 (“Depreciation and Amortization”)

 

2. Attach an “election statement” to your tax return, stating specifically that you wish to claim all (or the first $5,000) of your Start-Up Expenses in 2011, “the year in which your business became active.”

By the way, since Start-Up Expenses are deductible in the year in which the business begins active operation, if the business you are investigating never gets off the ground, you will not get any deductions. [ IRC Sec. 165 ]

Verizon, AT&T report Q3 results

The top two U.S. telecom operators, AT&T Inc (Dallas, Texas, U.S.A.) and Verizon Communications (New York) reported financial results from the third quarter of 2011.  Both companies reported increased revenue from the year-ago quarter; although AT&T’s revenue was below analyst expectations, while Verizon’s revenue was slightly higher than expectations.  Both companies’ revenue was affected by weak smartphone sales in the third quarter.

 

Analysts noted that Verizon Wireless handily beat their wireless profit margin estimates — a record 47.8% margin based on EBITDA (earnings before interest, tax, depreciation and amortization) as a percentage of service revenue, says Reuters.

 

Stifel Nicolaus (St. Louis, Mo., U.S.A.) analyst Chris King said AT&T’s 43.7 % profit margin from wireless services was well ahead of his expectation for 41.9%.  Although, he also said its third-quarter ARPU (average revenue per person) of $63.69 missed his $64.50 expectation.

 

“The primary driver of ARPU (average revenue per customer) in Q3 was slower smartphone growth. As smartphone growth continues in Q4 we expect (ARPU) growth to pick up,” Ralph de la Vega, the head of AT&T’s mobile business, told analysts on a conference call.

 

According to analysts, Verizon and AT&T’s third quarter results were affected by the customer purchase delays ahead of the iPhone 4S launch.  Customers held out on purchasing the smartphone until the newest version was launched after the close of the quarter, causing a decrease in sales and revenue.

 

AT&T’s quarterly revenue fell short of Wall Street estimates, while Verizon’s were relatively in line with estimates.  AT&T had an operating revenue of $31.48 billion, down from $31.58 billion in the year-ago quarter.  It also fell below analyst expectations of $31.60 billion.  Verizon reported Q3 revenue of $27.9 billion, up from$26.6 billion in the year-ago quarter, and slightly ahead of analyst estimated of $27.88 billion.

 

In the smartphone segment, AT&T activated 1 million iPhone 4S smartphone as of Tuesday, although this was after the end of the third quarter.  Verizon stated that it also had a strong demand for the iPhone 4S, but did not provide numbers.

 

Verizon’s Chief Financial Officer Fran Shammo did tell analysts that Verizon Wireless sold 2 million iPhones in the third quarter but that only 20% of its iPhone customers were new subscribers.

 

Verizon Wireless added 882,000 subscribers in the third quarter, more than doubling AT&T’s 319,000 added subscribers.  Verizon fell below the average analyst expectation of 1.04 million new subscribers, while AT&T exceeded the expectation of 311,000 new subscribers, according to Reuters.

Student loan debt hits record levels

Students and workers seeking retraining are borrowing extraordinary amounts of money through federal loan programs, potentially putting a huge burden on the backs of young people looking for jobs and trying to start careers.

Full-time undergrads borrowed an average of 4,963 last year, according to the College Board.

The amount of student loans taken out last year crossed the $100 billion mark for the first time and total loans outstanding will exceed $1 trillion for the first time this year. Americans now owe more on student loans than on credit cards, reports the Federal Reserve Bank of New York.

Students are borrowing twice what they did a decade ago after adjusting for inflation, the College Boardreports. Total outstanding debt has doubled in the past five years — a sharp contrast to consumers reducing what’s owed on home loans and credit cards.

Taxpayers and other lenders have little risk of losing money on the loans, unlike mortgages made during the real estate bubble. Congress has given the lenders, the government included, broad collection powers, far greater than those of mortgage or credit card lenders. The debt can’t be shed in bankruptcy.

The credit risk falls on young people who will start adult life deeper in debt, a burden that could place a drag on the economy in the future.

“Students who borrow too much end up delaying life-cycle events such as buying a car, buying a home, getting married (and) having children,” says Mark Kantrowitz, publisher of FinAid.org.

“It’s going to create a generation of wage slavery,” says Nick Pardini, a Villanova University graduate student in finance who has warned on a blog for investors that student loans are the next credit bubble — with borrowers, rather than lenders, as the losers.

Full-time undergraduate students borrowed an average $4,963 in 2010, up 63% from a decade earlier after adjusting for inflation, the College Board reports. What’s happening:

•Defaults. The portion of borrowers in default — more than nine months behind on payments — rose from 6.7% in 2007 to 8.8% in 2009, according to the most recent federal data.

•For profit-schools. The highest default rates are at for-profit schools that tend to serve lower-income students and offer courses online. The University of Phoenix, the nation’s largest, got 88% of its revenue from federal programs last year, most of it from student loans.

“Federal student loans are like no other loans,” says Alisa Cunningham, research chief at the Institute for Higher Education Policy. “The consequences are so high for making a mistake.”

Nielsen: Android smartphone purchases now top iOS 2-to-1

More than half of all U.S. mobile subscribers who purchased a smartphone within the past three months selected a device running Google’s (NASDAQ:GOOG) Android operating system according to new data issued by Nielsen.

Android-powered devices accounted for 56 percent of all U.S. smartphone sales during the previous three months and now make up 43 percent of total nationwide smartphone market share, Nielsen states. Apple’s (NASDAQ:AAPL) iOS remains in second place with 28 percent U.S. market share–iOS devices also accounted for 28 percent of all smartphones purchased by American consumers during the last three months. Nielsen adds that iOS could experience a spike in the months ahead with its iPhone 5 expected to launch sometime during the next several weeks–iOS sales increase with each new device iteration or carrier partnership.

Fifty-six percent of all U.S. subscribers who purchased a new phone during the last three months selected a smartphone over a feature phone, Nielsen reports. Research In Motion’s (NASDAQ:RIMM) BlackBerry still makes up 18 percent of total U.S. smartphone market share, but only 9 percent of consumers purchased a BlackBerry device during the last three months. Rival operating systems make up 11 percent of the combined U.S. market and 6 percent of recent sales.
